1. Customer Eligibility
Yachts are chartered without skipper (i.e. bareboat charters) only to individuals (the "Charterer”) who hold one international sailing certificate, which is recognized in Greece by the Port Authorities.
If the Charterer wishes so, they can hire a skipper, who is an independent freelancer professional, and will insure the yacht navigation and safety during the Charter.
Copies of the licenses (and skipper's passport) must be presented via email when the yacht is booked to the charter company by the Charterer.
During the yacht delivery phase (check-in), the charter company holds the right to deny the delivery of the yacht in case the charterer is deemed not experienced to master the yacht (regardless of the possession of sailing certificate). The Base Manager is authorized by the charter company to deny such charters, for the safety of the persons and the yacht. In this case, the charterer is requested to hire a skipper in order to fulfill the charter. No money return can be provided if the charterer (who cannot master the yacht by himself) does not wish to hire a skipper and wishes to cancel the charter of the yacht. Before embarkation, the charterer is requested to present the original sailing certificate to the Charter Company and local Port Authorities.
2. Pricing
Included in the charter price:
- Yacht charter
- The use of yacht's equipment under the inventory list, as described in our quote
- Complete safety and galley equipment
- Dinghy with outboard engine (outboard with additional cost are defined in the quote).
- Bed linen (two bed sheets, one pillow case) and towels (one body towel, one face towel) one set per person
- Mooring fees on the first and last night of the charter
- Insurance and all tax (currently applicable VAT). All yachts are insured against risks arising from third party liability, sea pollution, damages of hull, machinery and equipment.
- As stipulated by Greek Law, Value Added Tax is collected by the Owner at the expense of the Charterer. The Charterer shall at all times be liable to pay for the VAT amount applicable by Law at the time the charter is executed. Charter VAT nominal rate is 24%. For charters of duration that exceeds 48 hours, on condition that it is proven to have sailed at high seas for over 60% of the charter period and over 60% of the distance travelled during the charter, then the nominal rate is discounted by 50% or more. Should the Charterer fail to fulfill the conditions for VAT discount application or should any changes in applicable tax legislation take place after the issuance of the charter agreement, that result in change of final charter VAT and hence of total amount(s) due, then the difference will be credited or debited accordingly to the Charterer. VAT legislation and the resulting VAT rates and conditions applicable are subject to change without prior notice, at no responsibility of the Broker, Stakeholder or Owner.
- This list may be a subject to modifications. All the changes will be precisely stated in the quote sent by the charter company, prior to booking
Not included in the charter price:
- Fuel, water: The yacht is delivered with full tanks of fuels and water. Upon return, the fuels are re-filled and the cost is paid by the charterer
- Running expenses, toiletries, provisions (food and drink supplies)
- Mooring fees, water / electricity refueling during the charter
- Skipper fee (optional), paid on embarkation day
4. Payment Policy
- A 50% deposit is required, upon signing the charter contract and within 7 days of the booking confirmation, via bank transfer
- The remaining balance of 50% is required 30 days prior to departure, via bank transfer
- Failure of the charterer to complete payments on amounts and dates agreed may result to cancellation of the charter, without the right of the charterer for refund.
5. Extras
- Service pack: End cleaning of the yacht, set of bed linen, pillows, bath&face towels, fuel for the outboard, spare bottle with gas. The service pack fee is paid at the base, prior to embarkation.
- Refundable security deposit is charged on embarkation day from credit card of the charterer. It covers the possible cost of damages or equipment loss to the yacht. On day of return, deposit is cancelled provided no damages have occurred. In case of damages, the amount withheld equals the cost of damages, up to the amount of the security deposit.
- The Charterer is advised to inform their bank days before the transaction, in order to ensure that any lawful transaction will not be rejected.
- Crew meals: In case of hired crew, the charterer undertakes the obligation to cover the expenses of food and beverages of the crew. This can be met either by providing the meals for the crew onboard or on the land, or by handing a reasonable amount of money for the daily expenses of the crew (i.e. € 30 / day for each crew member).
- The Charter is responsible to cover the running expenses of the yacht during the charter period, including port fees, water / electricity refilling in the ports.
- Fuels: Upon return of the yacht to the home port, the Charterer undertakes the cost to refill the yacht with the fuels, i.e. re-deliver the yacht with full fuel tanks.
6. Embarkation day/time: Saturday, 17:00 hrs / Disembarkation day/time: Saturday 09:00 hrs.
Yacht must be back on the base one day before the end of the charter, by 18:00 hrs the latest. The charterer agrees to redeliver the Yacht together with all her equipment, in the same good condition as she was at take-over, but, unless the yacht has become a total loss, if they shall for any reason fail to deliver the Yacht at the aforesaid date and time, to pay to the charter company demurrage at the rate of the charter price per day of this Agreement increased by fifty percent (50%), for every day or fractional part of a day there-after until delivery has been effected. If the Charterer leaves the Yacht at any place other than the agreed port, to pay to the all expenses involved in transferring the yacht to the place of redelivery and pro-rata demurrage as above for the number of days required for this transfer, as well as for any loss or damage not covered by the insurance policy, which may occur on or to the yacht until she has been taken over again by the charter company / yacht owner.
The charter company requires some personal information from the Charterer to complete the required documentation of the charter. In case of delay from the Charterer, resulting in sending the documents in period less than two weeks before the charter, the charter company cannot guarantee the timely preparation of the documents, and consequently the timely embarkation to the yacht, without any responsibility on the charter company and its representatives.
The Charterer is requested to forward the necessary information to the charter company on a timely manner to avoid any delays.
7. Yacht Specifications and Equipment:
Prior to booking the yacht, the Charterer received a detailed description of the reserved yacht's specifications and equipment through a weblink provided with the offer. The charter company takes great care in presenting accurate information, including photos, specifications, and equipment for all yachts. However, with the increasing number of yachts, errors or misprints in the information presentation may occur unintentionally.
Please note that the charter company cannot accept liability for any misinformation that may have been presented. We strive to ensure the accuracy of the information, but it is essential for the Charterer to take necessary steps to confirm specific details of the yacht's equipment.
To confirm any specific equipment or details that are of particular importance to the Charterer, such as the type of sails, availability of A/C, Audio system, etc., the Charterer is kindly requested to confirm equipment via email with the Charter Company
8. Cancellation Policy
In the event of cancellation of the charter by the Charterer, for any reason, the following cancellation policy will apply and depending on the time-interval between the booking confirmation and the cancellation date:
- Cancellation fee of 30% of the total charter fee, for bookings cancelled within a period of more than 90 days prior to boat embarkation.
- Cancellation fee of 50% of the total charter fee, for bookings cancelled within a period of 90-30 days prior to boat embarkation.
- Cancellation fee of 100% of the total fee, for bookings cancelled in a period less than 30 days prior to boat embarkation
- In case that the yacht under cancellation is re-chartered to another charterer for the same period and under the same conditions, only the dossier expenses will be charged at EURO 300.
- Cancellation of Crew arrangements (Skipper or Hostess): if notice of cancellation is given 1 to 30 days prior to departure, 100% of agreed services price is due.
9. Safety
The Charterer agrees not to leave a port or anchorage if the wind force is or is predicted to be over six (6) of the Beaufort Scale or if the harbor Authorities have imposed a prohibition of sailing or while the Yacht has unprepared damage or any of her vital parts such as engine, sails, rig, bilge pump, anchoring gear, navigation lights, compass, safety equipment, etc. are not in good working condition or without sufficient reserves of fuel or in general, when weather conditions or the state of the Yacht or its crew or a combination of them concerning the safety of the Yacht and her crew is doubtful.
The charter company can accept no liability in case that any of the Charter Conditions, e.g. embarkation / disembarkation hours, permission to sail, etc, are affected by State / Port Authority regulations, due to Force Majeure, or other, unforeseen cause.
10. Disputes
In the event of any dispute arising between the parties, it will be resolved by the Court in the region of the Charter
11. Privacy policy
The processing (i.e. collecting, recording, organizing, structuring, storing, adapting, altering, retrieving, consulting, transmitting, disseminating or any other type of processing) of the Charterer's personal data is necessary for the performance of a contract between the Charterer and the Charter Company, and is therefore based on the legal basis of performance of a contract, in accordance with EU Regulation 2016/679 (GDPR). The Charterer's personal data will be processed for the purpose of declaring the intention of the Charterer to charter a yacht, to sign a charter party and to execute this charter. The Charterer's personal data will also be used for the transfer to the owner of the yacht or to other professionals, for the purpose of transferring the yacht, its service, etc. The Charterer may provide additional consent for the usage of their personal data for marketing purposes. The Charterer's personal data will be kept in the Company's archive for as long as necessary to fulfill the purposes for which they were collected. The Charterer has the right to access their own data, obtain information, ask for rectification or restriction, exercise their right to erasure (right to be forgotten), exercise their right to data portability, and their right to object.
